Terms of Use
Effective date: October 1st 2025
Acceptance
By accessing or using any Ginspire Health website, portal, content, or services, agreement to these Terms of Use is confirmed. If any part of these Terms is not accepted, please discontinue use of the site and services.
Who we are
Ginspire Health offers convenient virtual care, expert guidance, and discreet delivery for personalized wellness and midlife care across the United States. Services may include consultation, lab coordination, treatment planning, and home delivery when permitted by law.
These Terms govern website and portal use, non-clinical content, access, e‑commerce, and account features, while clinical care is provided by licensed clinicians under separate consents and policies. Where clinical care is involved, HIPAA and the Notice of Privacy Practices govern handling of protected health information in addition to these Terms.
Website content is for general informational and educational purposes and is not a substitute for professional diagnosis or treatment. Only advice delivered directly by a licensed clinician during a patient encounter constitutes medical guidance for the individual patient.
Telehealth services and this site are not for emergencies or emergency monitoring. In a medical emergency, call 911 or go to the nearest emergency department immediately rather than using online services
Use of the site requires legal capacity to enter into a binding agreement and compliance with applicable laws in the user’s location. Certain services may be available only to residents of jurisdictions where clinicians are licensed and services are legally permitted.
Account holders are responsible for maintaining the confidentiality of credentials and all activity under the account. Ginspire Health may suspend or terminate accounts that violate these Terms or pose security or misuse risks.
By booking and attending virtual visits, patients agree to telehealth encounters delivered via secure technologies as described in applicable telehealth consent forms. Telehealth encounters may rely on information provided by the patient, connected devices, questionnaires, video, images, and medical records, which have inherent technical limitations.
Care may involve ordering laboratory tests and coordinating with licensed pharmacies for fulfillment and discreet delivery when permitted. Third‑party labs and pharmacies operate under their own policies and professional obligations, and may require identity verification and compliance with applicable laws.
There is no guarantee that any prescription will be issued, and prescribing decisions rest solely with the clinician’s professional judgment and applicable law. Certain controlled substances and non‑therapeutic drugs cannot be prescribed via telehealth and may be restricted by federal or state rules.
Fees, product prices, shipping charges, and taxes may change at any time, and will be disclosed prior to checkout or scheduling where applicable. Users are responsible for charges associated with visits, tests, medications, and services not included in visit fees unless otherwise stated.
Shipping and delivery
When fulfillment is offered, treatments may be shipped in discreet packaging to the address provided, subject to availability, legal restrictions, and carrier policies. Delivery timelines are estimates and not guarantees, and risk of loss may transfer upon carrier acceptance as permitted by law.
The site may not be used to violate laws, infringe rights, harm others, disrupt systems, harvest data, or attempt unauthorized access to any account or service. Automated scraping, reverse engineering, or misuse that degrades performance or security is prohibited.
Email and messaging channels may be used for scheduling, account notices, and general information, while clinical matters are reserved for appropriate care channels as directed by clinicians. Users may manage non‑transactional email preferences, but essential service communications will continue as needed for safety and compliance.
Non‑PHI collected via the site is handled under the Privacy Policy, while PHI is handled under the HIPAA Notice of Privacy Practices and applicable law. HIPAA sets standards for permitted uses, disclosures, patient rights, and breach notifications related to PHI.
All site content, design, text, graphics, logos, icons, and software are owned by or licensed to Ginspire Health and protected by intellectual property laws. No right or license is granted except as expressly permitted for personal, non‑commercial site use.
Links, embeds, or integrated tools from third parties are provided for convenience, and those parties’ terms and privacy practices apply to their services. Ginspire Health is not responsible for third‑party content, availability, or performance.
The site and its content are provided “as is” and “as available” without warranties of any kind, express or implied, to the fullest extent permitted by law. No warranty is made regarding uninterrupted access, security beyond reasonable safeguards, or error‑free operation.
To the maximum extent permitted by law, Ginspire Health is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from site use or inability to use the site. Where liability cannot be excluded, it is limited to the amount paid, if any, for the service at issue during the twelve months preceding the claim.
Users agree to indemnify and hold harmless Ginspire Health and its personnel from claims, damages, losses, and expenses arising from misuse of the site, violation of these Terms, or infringement of rights. This obligation survives termination of these Terms.
These Terms may be updated from time to time to reflect legal, operational, or security changes, with the effective date updated upon posting. Continued use after changes indicates acceptance of the updated Terms.
These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict‑of‑law rules, based on the company’s current contact location. Exclusive venue and jurisdiction lie in state or federal courts located in Florida, unless otherwise required by applicable telehealth or consumer protection laws.
Access to some or all of the site may be suspended or terminated at any time for security, legal, or policy reasons, or due to violation of these Terms. Provisions that by their nature should survive termination remain in effect, including IP, disclaimers, limitations, indemnity, and governing law.
For questions about these Terms, contact support@ginspirehealth.com for assistance. Mailing address for legal notices: 1733 Avenida Del Sol, Boca Raton, FL 33432, USA.
Using the site, creating an account, or booking a consultation indicates understanding and acceptance of these Terms and all referenced policies, including the Privacy Policy and HIPAA Notice of Privacy Practices. Always seek immediate emergency care by calling 911 if experiencing a medical emergency rather than using telehealth services or this website.
